LED 照明の特許における技術的範囲の広さの定量分析

＜要旨＞
本研究では，LED照明の特許について，技術的範囲の広さの観点から，その技術進歩や権利化動向に一考察を加えるべく定量分析を行った．実際の定量分析は，特許発明の技術的範囲の広さと相関関係がある“格成分数”という定量的パラメータを用いて数値化した．その結果，出願時格成分数の平均値は，出願年に応じて僅かながら徐々に増加する傾向が現れていた．特許時格成分数の平均値は，出願年が後になるにつれて増加する傾向がより顕著に現れていた．特に直近の3年間（2007年～2009年）では，格成分数が急激に増大する傾向が明確に現れていた．この原因について，LED照明の技術領域における特許出願件数の増大により，当該技術領域において特許出願が密集することで，取得可能な特許発明の技術的範囲が狭くなったことを考察した．
<Abstract>
The purpose of this study is to analyze the size of technical scope on the patent of LED lamp. We focused on the number of noun phrase in grammatical case as quantitative parameter. I examined patent specification of patent right of LED lamp for latest 15 years. The result clearly show that the nearer patent filing date the larger the number of noun phrase of patent right. The reason of that tendency is increasing the number of patent application in recent years.
