<要旨>
現在,CBDの第10回締約国会議における,遺伝資源の利益配分に関する国際的枠組みの採択に注目が集まっている.本稿は,CBDを中心として,WIPO ・IGC,WTO ・TRIPS,FAO ・ITPGRにおける遺伝資源の利益配分と知的財産権をめぐる対応を比較し,いくつかのABS事例を取り上げたうえで,遺伝資源をめぐる原産国の主権と公共の利益のバランスについて考察するものである.
<Abstract>
The possible adoption of an international regime on Access and Benefit-Sharing (ABS) of genetic resources, that will be discussed during tenth meeting of the Conference of Parties to the Convention of Biological Diversity (CBD) in Japan, could be an important milestone for the CBD. This paper considers the balance between the sovereign rights of countries from which genetic resources originate and the public benefits of the products derived from these resources. The current discussions on genetic resources benefit-sharing and intellectual property rights under the CBD and other relevant international fora, such as the WIPO IGC, the WTO TRIPS and the FAO ITPGR, are examined as part of this discussion.
