<要旨>
知財立国の制度的整備が進む中,その制度を活用し,産業や事業に資する活動を行える知財人財の育成が急務である.そのとき,従来型の知財人財ではなく,知財マネジメントに寄与する新しい知財人財のモデル形成とその具体的育成が求められている.すなわち「知財人財イノベーション」が必要である.本論では,知的創造サイクルの中で知財の保護・権利化を担う,いわゆる「第一層の専門人財(弁理士,知財部員,特許庁職員等)」に焦点を合わせ,現状を踏まえつつ,そのモデルの変容と多様化について4つの動向(融合化,広域化,分化・専門職化,流動化)を論ずる.すなわち,科学技術,知財法務,経営の三分野が重なる知財マネジメントを担う人財,隣接関連領域の素養を幅広く持つ専門人財,知財中核領域の専門人財を補助・補佐・支援する人財,知財専門職として弁理士,知財部員,特許庁職員等を行き交う人財,が求められていることについて議論を行う.
<Abstract>
In the recent years in Japan, while the reform of laws and institutions of intellectual property (IP) has been accelerating, human development of IP professionals is not sufficient. Not the conventional model of IP professional who works for IP itself but some new models who work for industries and businesses are highly required. This request leads to “the Innovation of Professionals in Intellectual Property Management”.
This paper focuses on so-called “Professionals in the first layer”; patent lawyers, IP section members in companies, and the examiners in Japan Patent Office, and discusses four current movements which has been changing and diversifying the conventional models of IP; Not only science & technology and patent law but also business & management should be fusion up in IP professional works domain. Widening of knowledge of IP professionals are required, especially of business.
Differentiation of IP professional work is now being accelerated, and professionalization of IP office works, IP assistant works, and IP supporting works is expected. Professional career is now widening and dynamic.
