<要旨>
<Summary>
Competition laws generally treat favorably business conduct concerning standardization. For successfully concluding standardization, it is imperative to block hold-ups. For this objective, standard setting organizations (SSOs) need to obligate their member companies not only to promise RAND (reasonable and non-discriminatory) licensing conditions, but also to pre-disclose their IPs, together with promise of maximum royalty. At the same time, SSOs should endeavor to make ample room for members’ competition, in order to avoid being found engaging in illegal collusion by competition agencies and courts.
