授業目的公衆送信補償金制度後の著作物等の利用円滑化に関する著作権制度の動向

＜要旨＞
著作物等の利用円滑化方策に関し，授業目的公衆送信補償金制度後においても3つの立法事例がある．まず，令和3年改正における，図書館等における利用に関する権利制限措置の拡大があり，部分的に補償金制度が導入された．次に，同改正では，放送番組の同時配信等の円滑化に関する規定の整備があり，集中管理等と権利制限措置の組合せにより対応する手法が選択された．さらに，令和5年改正では，過去の著作物等やネット上の著作物等の利用について著作権者等の意思の確認が困難な場合に，適法な利用の根拠となる新たな裁定制度が導入された．これらの制度の概要をたどりつつ，著作物等の利用円滑化を進める際に重要な視点について考察する．
<Abstract>
With regard to measures to facilitate the use of copyrighted works, there are three legislative cases even after the compensation system for public transmission for the purpose of classes.　First, in the Reiwa 3rd year revision, there was an expansion of limitation on rights to use copyrighted works by libraries, etc., and a compensation system was partially introduced.　Next, in the same revision, there were provisions for the facilitation of simultaneous distribution of broadcast programs, and a method was chosen to deal with the situation by combining collective management and rights limitation measures.　Furthermore, in the Reiwa 5th revision, a new compulsory license system was introduced that serves as the basis for legal use when it is difficult to confirm the intension of copyright holder, etc., regarding the use of past works and works on the Internet.　While tracing the outline of these systems, we will consider important perspectives when promoting the facilitation of the use of copyrighted works.
