＜要旨＞
教育の使命は人格の完成をめざし，優秀な人材を育成することにある．この教育目的のために，教育者はICT 教育手法や良質のコンテンツを有効に活用する必要がある．そのことは同時に，多種多様な保護著作物が必要となることを意味する．著作権者等の許諾を得るために，教育者は時間と労力を費やさなければならなかった．2018 年の著作権法改正によって，教育機関が指定管理団体（SARTRAS）に補償金を支払うことによって，著作物の公衆送信が可能となった．これにより，著作権者の利益を不当に害しない限り，その許諾を得ることなく，教育者は著作物，実演，レコード及び放送を生徒や学生に公衆送信することができることとなった．本稿は，わが国の教育目的で行う公衆送信の補償金制度を取り扱う．特に，著作権法35 条の建付け，SARTRASの業務，及びそこでなお解決されるべき課題について論ずるものである．
<Abstract>
Education shall aim for fully development of personality and for developing excellent human resources.　In order to realize this educational purpose, teachers and professors have to make good use ICT educational methods and good contents.　But at the same time, consequently, protected large scale of works are necessary.　To authorization of the copyright owner, they must waste his too much time and a lot of energy. As a result of the 2018 amendment copyright law, it has become possible for each educational institution to publicly transmit a work by paying remuneration to designated performing copyright society （SARTRAS）.　By doing this, without obtaining the authorization of the copyright owner, teachers and professors can transmitting a work, performance, record and broadcast his/her pupils and students via the internet, provided that they do not unreasonably prejudice the legitimate interests of the right holder. This article is dealing with the compensation system for public transmission for educational purposes in Japan.　In particular, I would like to mention structure of article 35 copyright law, task of SARTRAS and the issues that need to be resolved there.
