＜要旨＞
近年，中国におけるデザイン保護は法改正によって一定の進展を見せたものの，特にデザインの権利主体に関しては，依然として多くの課題に直面している．本稿は，まず，著作権法制度と意匠法制度を中心とする中国におけるデザイン保護の法的枠組みを整理し，次に，デザインの権利主体に焦点を当てて，特に中国著作権法に規定される一般作品，委託作品，職務作品及び特殊職務作品，法人作品といった作品の種類ごとの権利帰属について考察を行い，関連課題を検討する．
<Abstract>
In recent years, design protection in China has made certain progress through legal revisions, however, there are still numerous challenges, particularly concerning the ownership of design rights.　This paper first organizes the legal framework of design protection in China, focusing on the copyright system and the industrial design system.　
It then examines the ownership of rights in various types of works stipulated in Chinese copyright law, such as general works, commissioned works, works created in the course of employment, special works created in the course of employment, and corporate works, with a focus on the issue of design ownership, and analyzes the related challenges.
