＜要旨＞
本特集企画のテーマ「デザイン契約法」は，デザイン創作者の「権利」に焦点を当ててデザインを取り巻く法環境を検討するものである．デザイン創作に携わる者が，その働き（主に知的創作活動）が適切に評価されることによって創作活動は活性化するであろう．そして，創作活動が活性化することによって，デザインの質は向上し，デザインを利用する者（主に企業）の利益にも繫がるものと考える次第である．
このような観点から，本稿ではデザイン創作の過程を概観すると共に，意匠法をはじめとする知的財産法及び不正競争防止法における創作の保護を検討する．検討の視点は，法律はデザイン創作者の「権利」をどのようにサポートしているのか，という点である．そして，検討結果をデザイン契約の法的な裏付けとして位置づける道筋を提示する．
<Abstract>
The theme of this special project, ‘Design Contract Law’, examines the legal environment surrounding design, focusing on the ‘rights’ of design creators.　Creative activity will be stimulated if those involved in design creation are appropriately recognized for their work （mainly intellectual and creative activity）. This will improve the quality of design and benefit the users of design（ mainly companies）.
From this perspective, this article provides an overview of the design creation process and examines the protection of design creation under design law, intellectual property law and unfair competition law.　The perspective of the examination is how the law supports the ‘rights’ of the design creator.　The results of the examination are then presented as a way to position the results of the examination as legal support for design contracts.
