ドイツにおける「デザイン契約法」
── 著作権契約法の視座からの把握の試み

＜要旨＞
本稿は，近時議論の対象となることが増えてきた著作権契約法において「各論」に位置付けられることもあるデザイン契約法について，ドイツ法における概観の把握を試みるものである．ことにデザインについては，デザイン活動の多様性による統一的なデザイン契約法像の描出の困難さが意識される中でも，いくつかのモデル契約が発展してきたとの概観（II）に続いて，デザイン契約法を構成する重要法規として，意匠法，著作権法，欧州共同体意匠規則におけるデザイン保護と判例等における問題点を概観（III）する．これを踏まえて，ドイツ著作権契約法（総論的部分）の近時の展開を，とりわけ（著作権契約法「各論」部分の構成要素ともなりうる）各業界の自主規制的な共通報酬規定の制定誘因を設けるという団体法規制の狙いに着目して述べ，続いて，著作権契約法「各論」をなす一類型としての，デザイン契約法の性質的特徴と個別的な問題点の捕捉を試みた（IV）．
<Abstract
This Essay attempts to provide an overview of design contract law, which can be considered as one of the specific areas of copyright contract law, which has become the subject of increasing debate in recent years.
First, Chapter 2 provides an overview of the development of model contracts, despite the difficulties in drawing up a unified design contract law due to the diversity of design activities in each field.　Chapter 3 then provides an overview the design protection in the Design Act, Copyright Act, etc., and the issues in each law and case law, that make up design contract law.　Based on this, Chapter 4 describes the recent development of the German Copyright Contract Act, focusing particularly the aim of group legal regulation to create incentives for the establishment of voluntary, industry-specific remuneration regulations, and then attempts to capture the nature and specific issues of design contract law as a specific topic of copyright contract law.
