＜要旨＞
我が国においては，デジタル・トランスフォーメーション（DX）とそれによって実現するSociety5.0 に注目が集まっている．それらの前提となるデータ利活用について，スタートアップに焦点を当てながら，スタートアップとデータ利活用及びデータ利活用に関連する政策と法令を概観し，行政規制への対応，契約実務といったデータ利活用の課題とバックオフィス機能が整っていないスタートアップ特有の課題を挙げ，その解決に向けたポイントについて触れる．
<Abstract>
In our country, attention is focused on digital transformation （DX） and Society5.0 that will be realized through it.　Concerning the data utilization which is the premise of the above, while focusing on the start-up company, the policies and laws related to the start-up company, data utilization, and data utilization are outlined, and the issues of data utilization, such as response to administrative regulations and contract practice, as well as the issues specific to the start-up company that do not have the back office function, are mentioned, and the points for the solution are mentioned.
