＜要旨＞
「現代の石油」といわれるデータの利活用に向けた環境を整備するために，平成30年の不正競争防止法改正により，限定提供データ制度が創設された．本稿では，同制度の施行後3年の検討に先立ち，その運用上の課題を検討した．さらに，本稿では，抜本的なデータ利活用促進策として，データ共有が直面する主な障壁を克服するために必要と思われる，（1）データオーナシップに関する契約の高度化,（2）データポータビリティの確立，について我が国における取組状況を検討した．
<Abstract>
In order to improve the environment for the utilization of data, which is referred to as “modern oil”, the Limited Provision Data System was established by the 2018 revision of the Unfair Competition Prevention Law.　This paper examines the operational issues of the system prior to its examination three years after its enforcement.　In addition, this paper examines the status of efforts in Japan on（1）the sophistication of contracts on data ownership and（2）the establishment of data portability, which are considered necessary to overcome the main barriers facing data sharing as a drastic measure to promote data utilization.
