＜要旨＞
海賊版サイトは，極めて巧妙に法的・技術的な抜け穴をつき，時間を稼ぎつつ多額の利益を獲得している犯罪ビジネスと化している．このような状況に鑑み，コンテンツ事業者・団体等は様々な民事上・刑事上の対策を凝らしていた．しかしながら，其々の対策には時間とコストがかかり，その間にも被害は拡大していくという最悪の状況に陥ってしまった．そこで，海賊版サイトへの新たな対抗手段としてサイトブロッキングを立法す ることが議論されるようになった．しかしながら，政府での議論がまとまることはなく立法することは叶わなかった．現在政府では，サイトブロッキングを含めた海賊版対策のメニューを作成し，まずはサイトブロッキング以 外の有効性について順次検討を進めている状況にある．本稿では，海賊版サイト対策をめぐる政府の動きを概観し，最近の海賊版サイトの状況について説明するとともに，今後の対応策について重要であると思われることについて私見を述べる．
<Abstract>
Piracy-websites have become a highly sophisticated criminal business with legal and technical loopholes to buy time and make huge profits. In view of this situation, content providers and organizations devised various civil and criminal measures. Unfortunately, with these measures taking time and cost, the damage was getting worse. This led to the discussion of legislation for site-blocking as new measures against piracy-websites. Yet, the government could not reach an agreement on the issue, failing to enact the law. Currently, the government has been drafting a menu of measures against piracy, including site-blocking, and considering the effectiveness of a serious of measures other than site-blocking. This article will provide an overview of the government’s activities on measures against piracy-websites, explain the recent situation on piracy-websites, and set forth personal viewpoints on future measures that seem to be important.
