中国におけるデータの知的財産法における保護・活用と課題

<要旨>
デジタル革命に基づく第四次産業革命が世界中を席巻しつつある現在,多くのビッグデータを生むIoT (Internet of Things),学習モデルやデータに依拠するAI (Artificial Intelligence) 等の技術は最も注目される分野である.これらのIoTやAI技術が,然るべき性能を発揮させるためには,大量のデータが必須となり,既にデータは国家戦略をもって扱う必要のある「資源」となっている.ところが,中国の場合,データ保護等に係る専門法律がまだ立法されていない(2019年4月30日時点).裁判実務上では,データに基づく個人名義紛争(個人情報の紛争等)や経済紛争の多発に対し,民法等基本法や著作権法・反不正当競争法等知的財産法の解釈によって権利保護が行なわれている.本稿では,IoTやAIに関連するデータの種類を分析し,データの各種類およびその収集,処理,保存等の中国知的財産法における権利保護の在り方,その活用と課題について検討する.
<Abstract>
Today, the fourth industrial revolution based on the digital revolution is spreading globally, and many technologies such as the Internet of Things (IoT) that generates big data, Artificial Intelligence (AI) that relies on learning models and data have received the most attention. In order to make these IoT and AI technologies exhibit appropriate performance, a large amount of data is essential, and data has already become a “resource” that needs to be handled under the national strategies. However, in the case of China, specialized laws concerning data protection etc. have not been legislated yet. In court practice, against frequent personal name disputes (disputes of personal information etc.) and economic disputes based on data, the rights protection has been carried out based on the interpretation of the basic laws such as the Civil Law, etc. and the laws involving intellectual property rights such as the Copyright Act and the Anti-Unfair Competition Law, etc. In this article, I will analyze the types of data related to IoT and AI, and discuss the way of right protection of each type of data, and collection, processing, and storage of data, etc. in Chinese intellectual property laws, and will consider the utilization and problems thereof.
