農林業分野における地理的表示の分析 :産品の時間・空間的多層性と制度の関係性に着目して

＜要旨＞
地理的表示保護制度は，産地と強いつながりを有する産品を登録する制度であり，品質に関する生産工程まで登録する点に特徴がある．いわば，登録産品は「産地と時空間的結びつき」を有しているともいえる．既存研究では，商標等の他制度と比較した分析はなされているが，内容面において時間や空間に着眼した分析は限定的である．そこで本研究では，産品と地域との関連性について，時空間的な広がりに着眼する．例えば，「伝統性」という概念を制度設計の側からは「25年以上」といった単線的，組織的に扱える単位への翻訳がなされているが，実際の伝統野菜には，伝統性の多様な定義が存在するなど，時間的多層性がみられる．加えて，複数の県にまたがる産地を形成しているジャスミンライスや，日本の登録産品の全国的な傾向の分析を通して，制度側の要求と，産品の時空間的な特徴との緊張関係も，地理的表示の登録が進まない一因ではないかという仮説を提示する．
<Abstract>
In the Geographical Indication (GI) protection system, local products with strong connections with production areas are registered. The products' quality standards and production processes are registered in addition to the names of the products with regional names. The GI products have spatio-temporal connections with production areas. In existing research, comparative analysis of institutions such as GIs and trademarks are conducted. On the other hand, research focusing on spatio-temporal aspects of the products is limited.　In this research, spatio-temporal characteristics of the products are focus. For example, Japanese GI system defines traditional products as the products with more than 25 years history, however, Japanese traditional vegetables have diverse definitions of tradition. In other words, the vegetables have temporal multi layers. In addition to the case of the traditional vegetables, the case of Jasmine rice that has production areas overlapping with several administrative areas of prefectures in Thailand, and overall trends of Japanese GI products are analyzed. Finally, the hypothesis that tense relationship between institutional requirements and spatio-temporal multilayers of local products can be a factor behind why the registration of GI is not progressing smoothly is demonstrated.
