<要旨>
我が国は,明治三十二(一八九九)年にパリ条約とベルヌ条約に加盟し,初めて知的財産権の保護に関する国際枠組みに参加した.明治二十七(一八九四)年の日英通商航海条約の結果である.所謂不平等条約改正のため,欧米諸国と交渉を行なっていた明治政府は,同条約によって,悲願であった法権回復を達成することになったが,一方で日本の両条約加盟も規定されていたためである.
しかし,この過程の詳細は明らかにされてこなかった.とりわけ,大隈期(明治二十一(一八八八)年頃から同二十二(一八八九)年十月)は,日本の近代化の進展に伴う,知的財産権の保護を巡る外交交渉への影響を検討する上で極めて興味深い時期であった.
そこで,当該期において,日本と欧米諸国(英米独)との間で,知的財産権の保護を巡って,どのような外交交渉が行なわれていたのかについて,日英米独の外交文書を用いて明らかにする.
<Abstract>
The Japanese Government had negotiated with the Western Powers to revise ‘unequal treaties’ since the 1870s. Consequently, the Anglo-Japanese Treaty of Commerce and Navigation was concluded on the 16th July, 1894, which also provided that the Japanese Government undertook to join the International Conventions for the Protection of Industrial Property and Copyright before the cessation of British Consular jurisdiction in Japan. In 1899, subsequently, Japan entered the Paris Convention for the Protection of Industrial Property which was adopted on the 20th March, 1883, and the Berne Convention for the Protection of Literary and Artistic Works which was adopted on the 9th September, 1886.
But the process which Japan entered these Conventions has not been researched. In particular, the period from 1888 to 1889, when Okuma Shigenobu had been the Japanese Foreign Minister was significant. Because the Western Powers began to feel the necessity for protection of intellectual property rights, as the modernization of Japan was advancing.
Therefore, the purpose of this study is to make clear the treaty revision negotiations between Japan and the Western Powers in 1888-1889.
