<要旨>
我が国の知財訴訟を統計的にみた場合,原告に有利な条件で成立した和解件数をも考慮に入れると,諸外国と比べて原告勝訴率は決して低くはなく,実態に即した統計情報の発信が望まれる.原告(特許権者)に追い風といえる統計的傾向としては,訴訟・審判において特許の進歩性が認められやすい点が挙げられる.
知財訴訟動向として注目すべきは,①法文解釈の深化を伴う新判断が続々と出されていること,②判決形成過程において,裁判所がアミカスキュリエ (Amicus Curie) 制度や専門委員制度を活用して積極的に意見聴取に取り組んでいることが挙げられる.
<Abstract>
As to statistic aspect of Japanese IP litigation, plaintiff’s success rate is not lower than that of foreign countries (e.g., United States, Germany) considering the number of case which is settled in favor of plaintiff. It is preferable to disseminate statistical information which reflects actual IP dispute practice in Japan. Another recent featured statistic aspect in favor of plaintiff (patentee) side is significant increase of percentage that registered patent’s inventive step is affirmed by courts and patent office.
Recent trends in Japanese IP litigation are that (i) the new rule-making court decisions are rendered one after another, and (ii) the IP court proactively uses opinion hearing system such as Amicus Curie system and Expert Commissioner system.
