<要旨>
近年,職務発明訴訟の件数は減少してきており,1億円を超えるような高額な判決は見かけなくなった.しかしながら,平成16年特許法第35条改正前に会社に譲渡された発明は,改正後の現在においても訴訟となる可能性が少なくない.職務発明訴訟が提起されると,会社側にはその対応のため,判決による対価の額よりも大きな負担を背負うことがある.会社側はこのような負担を伴う職務発明訴訟の発生を未然に防止する必要があるとともに,職務発明訴訟が提起されてしまった場合には,迅速かつ的確な対応が必要となる.
<Summary>
The number of a lawsuit of employee invention was decreasing and it stopped in recent years, seeing the judgment which orders big-ticket payment which exceeds 100 million yen to an employer. However, invention transferred before the legal revision of Article 35 of Patent Law in the Heisei 16 fiscal year may cause a lawsuit also in the present after revision. When a lawsuit of employee invention is raised, the company side may shoulder a bigger burden than the amount of payment ordered by judgment for a load of lawsuits. The company side needs to prevent beforehand generating of a lawsuit of employee invention accompanied by such a burden. Moreover, when a lawsuit of employee invention has been raised, quick and exact correspondence is needed.
